These Terms and Conditions govern the use of the Fixpress3D website and services, including the request, design, production, and sale of custom test fixtures, fixture components, and related products.
By accessing this website or placing an order, you agree to comply with these Terms and Conditions.
Sale and Use
1. Website Owner

These Terms and Conditions govern:

quotation requests and file uploads
They apply to both B2C (consumers) and B2B (professionals and companies), unless otherwise specified.
3. Services and Products
The website provides:
sale of physical and/or digital products
custom-made and on-demand services
acquisition of technical files uploaded by the customer
automatic acceptance of a Non-Disclosure Agreement (NDA), where applicable
4. Ordering Process
Orders placed through the website constitute a binding purchase proposal.
The contract is concluded only after:
order confirmation sent by email
payment receipt, if required
5. Prices and Payments
All prices are in EUR
B2C: prices include VAT
B2B: prices exclude VAT, unless otherwise stated
Accepted payment methods:
bank transfer / PayPal
6. Delivery and Lead Time
Delivery times are indicative and non-binding
Delays do not entitle the customer to compensation
For custom or made-to-order products, lead times start after final customer approval.
7. Right of Withdrawal (B2C)
Consumers may withdraw within 14 days from delivery, without providing reasons.
The right of withdrawal does not apply to:
custom or personalized products
services already started or completed
digital files made available for download
8. B2B Customers
For professional and business customers:
the right of withdrawal does not apply
conditions agreed during quotation prevail
any defects must be reported within 8 days
9. Warranty
B2C: legal warranty of conformity applies
B2B: warranty limited to what is explicitly agreed
10. Customer-Uploaded Files
The customer declares to:
own or have rights to all uploaded files
indemnify the website owner against third-party claims
Uploaded files:
are used exclusively to perform the requested service
may be deleted after processing, unless legally required otherwise
11. Intellectual Property
All website content (texts, images, logos, layouts) is the exclusive property of Fixpress3D and may not be reproduced without written permission.
12. Limitation of Liability
Fixpress3D shall not be liable for:
temporary service interruptions
technical errors
improper use of products or services
Liability shall in any case not exceed the amount paid by the customer.
13. NDA and Confidentiality
Where applicable, submitting files or requesting quotations implies acceptance of the applicable Non-Disclosure Agreement (NDA) published on the website.
14. Amendments
Fixpress3D reserves the right to modify these Terms at any time.
Changes become effective upon publication on the website.
15. Governing Law and Jurisdiction
These Terms are governed by Italian law.
B2C: jurisdiction of the consumer’s residence
B2B: exclusive jurisdiction of Turin (Italy)
16. International Shipping – Customs, Import Duties and Incoterms
International Shipments and Incoterms
Unless otherwise agreed in writing, all international deliveries are made under Incoterms® 2020 – DAP (Delivered At Place).
Under DAP terms:
Fixpress3D is responsible for arranging transportation to the agreed destination.
The purchaser is solely responsible for import clearance.
The purchaser bears all customs duties, import taxes, VAT, brokerage fees, and any other charges imposed by the destination country.
16.1 Customs Duties and Import Charges
For shipments outside the European Union, any customs duties, import taxes, clearance fees, storage costs, inspection fees, or other charges imposed by authorities or carriers are exclusively borne by the purchaser.
Fixpress3D has no control over such charges and cannot estimate their amount.
16.2 Import Compliance Responsibility
The purchaser is fully responsible for:
Ensuring that the ordered goods comply with local import regulations
Providing any required documentation for customs clearance
Obtaining necessary import licenses or certifications
Fixpress3D shall not be liable for delays, seizures, inspections, or restrictions imposed by customs authorities.
16.3 Delays Due to Customs
Any delay caused by customs procedures, inspections, or regulatory checks shall not be considered a breach of contract and does not entitle the purchaser to:
Order cancellation
Compensation
Penalties
Refund of shipping costs
16.4 Refusal of Delivery or Failure to Clear Customs
If the purchaser:
Refuses delivery, or
Fails to complete customs clearance, or
Fails to pay required duties or taxes
The shipment may be:
Returned to sender at the purchaser’s expense, or
Abandoned or destroyed according to carrier/customs regulations
All related costs (return shipping, storage, administrative fees, disposal costs, customs penalties) shall be charged to the purchaser.
In such cases:
Shipping costs are non-refundable
Any additional expenses may be invoiced to the purchaser
16.5 Transfer of Risk
Risk transfers to the purchaser at the moment the goods are handed over to the first carrier.
17. Acceptance
Using the website and/or placing an order implies full acceptance of these Terms and Conditions.
